SouthCot provincial board bans open-pit mining

KORONADAL CITY (MindaNews/3 June) – The Sangguniang Panlalawigan of South Cotabato has voted to ban open-pit mining in the province, a move that merited praises from the staunchly anti-mining Catholic church.

“[It’s] Divine intervention!” declared Fr. Romeo Q. Catedral, social action director of the Diocese of Marbel who is leading the church’s opposition to large-scale mining. “This is a triumph for the people not only of South Cotabato but also nearby provinces,” he added.

Catedral and anti-mining groups have been closely following deliberations of the environment code the past two weeks as they urged the politicians leave a legacy that would protect the people and environment from the harms of open-pit mining.

Tampakan town in South Cotabato is at the center of a proposed large-scale mining operation, mainly for copper and gold, by the foreign-backed Sagittarius Mines, Inc. The copper deposits in the area are said to be the largest undeveloped resource in Southeast Asia.

On Wednesday, the SP, after a marathon session to deliberate on the province’s environment code, voted 5-4 banning open pit mining. There was one abstention while two other board members were absent.

The debate focused on the sentence “mining in any form shall not be allowed in the province of South Cotabato.” The board members eventually settled on “open pit mining method and all other forms of mining shall not be allowed in the province of South Cotabato.”

But in a special session on Thursday, the provincial board voted anew, 6 to 5, to ban only the open-pit mining method, according to Fr. Catedral, who still considers the development a victory. Open-pit mining has been considered by environment groups as the most destructive method.

Catedral said they will continue watching closely the deliberations – which has been going on for the last few years — until the environment code becomes an ordinance before June 30 as promised by the provincial legislators.

Sagittarius, however, seems unfazed over the development.

“The Philippine Mining Act [Republic Act 7942] allows open pit mining. A local law cannot supersede a national law,” said John B. Arnaldo, Sagittarius corporate communications manager.

The provincial environment code, thus, “won’t have a bearing in as far as the plans of the company to pursue the Tampakan project” is concerned, he said.

But Arnaldo said the company will continue the dialogues with the stakeholders.

i would like to know more about this issue. can i request that you upload a copy of the resolution passed by the Sanggunian Panglalawigan resolution and/or a copy of their environmetal code (if you have copies? I am neither pro or anti-mining. but i want to know the real facts on the issue.

Thanks for your interest.

However, because Gov. Daisy Fuentes still has to sign ordinance, there is no official copy yet available of the Provincial Environment Code. Her signature is expected to be given by June 30.

re: deliberation of South Cot local code

Thank you Sir Jaybee. I'll be waiting for the signing of the South Cot env't code. I would also like to ask about the deliberations that took place.There seems to be some conflicting information as reported by media. Some news reports say that the voting went 6-5 but other reports said the voting went 9-1 with 2 members abstaining. Or are both figures correct? If so, can you explain the chronology of the voting?

Is it correct to say that the provincial board first voted 5-4 (with 1 abstaining, and 2 members absent) to have the code state that “open pit mining method and all other forms of mining shall not be allowed in the province of South Cotabato” from the proposed “mining in any form shall not be allowed in the province of South Cotabato”?

And that in a special session the following day, the provincial board voted 6 to 5 in favor of banning only “the open-pit mining method.” And then lastly, the 9 board members voted in favor of the (final) environment code, 1 voted against it and 2 members abstained.

Can you clarify this matter Sir? Thank you very much once again.

1. Be civil. Basic courtesy and privacy norms should be practised by posters in this forum. Make your mom at least proud by showing you still remember to be polite, even if you're not required to say "po" or "opo" in every post you make. We wouldn't mind that either, if you do so. Then again, I am assuming here that you're already an adult.

2. Personal attacks will not be tolerated. This also applies to flaming. Just in case you don't know what flaming is, its deliberately insulting or personally ranting against a poster (or a thread) simply because you are losing the arguments.

3. Avoid being anonymous. Since you have enough time to post long comments, you would at least have a few seconds to type even an alias. You also help people conclude that you are not a paid hack from a PR firm by Intex (or any other mining company)

4. Do not shout in the forums. Do not use ALL CAPS in your posts. A single exclamation point should also suffice.

We will observe the forum in the next few days. Should these rules be disregarded, we will transform this into a minimally-moderated forum. We hope we will avoid the situation that we will decide to make this a closely and strictly moderated forum. We value everyone's insights so much.

We'll check up again on this new rules after a short while. Of course, we expect the Intex ECC to be revoked in a few days. In this case, I suspect that the "excitement" in this thread would have died down.
